This raises key questions around applicable law, representation rights, enforcement of collective agreements, and protection during restructuring or cross-border operations.
IFALPA’s Legal work helps Member Associations navigate these challenges, share expertise, and advocate for strong frameworks that protect pilots’ rights and professional standards.
Through its Legal Committee, IFALPA also addresses legal issues affecting safety, security, and governance, including emerging topics such as artificial intelligence in aviation.
Clear legal protections are essential to ensuring effective representation and safeguarding the profession.

Crew Detention
The arrest or detention of a pilot in a foreign country is an exceptional but serious situation that requires a prompt, coordinated, and informed response.
IFALPA provides guidance to support Member Associations in preparing for these circumstances and assisting pilots when they occur. This includes identifying appropriate legal assistance, coordinating with local pilot representatives, liaising with the airline, supporting the pilot’s family, and seeking consular or embassy assistance where necessary.
Preparedness is essential. Member Associations are encouraged to provide pilots with clear instructions on how to respond if arrested or detained abroad, including requesting legal representation, avoiding statements before receiving legal advice, and contacting their association or emergency support channels as soon as possible.
This work helps ensure that pilots are not left to navigate unfamiliar legal systems alone and that Member Associations are ready to provide timely, practical, and effective support.

Currently flying the Boeing 737 for WestJet, based in Calgary, F/O Ball started flying commercially in 2002. He paused flying to earn a law degree and practice Aviation Law full time for five years before returning to flying in 2015. James volunteered with the WestJet Encore MEC on the Negotiating Committee and was Chair of the Grievance Committee. He joined the IFAPA Legal Committee in 2020.

John E. (Jay) Wells, J.D., LL.M., has over thirty years’ experience handling aviation, labor, regulatory, administrative, international, employment and business law matters including aviation accident and incident investigation, representation and litigation. He has served as in-house legal counsel to ALPA International since 2000. Prior to joining ALPA, Jay worked in the U.S. Department of Justice Aviation Section and in private practice. He holds commercial pilot and flight instructor licenses.

Captain Judkins flies the B777 for British Airways. Active in international pilot affairs since 2006 when he became a Union Representative for BALPA, Kevin served as Vice-Chair of the British Airways Company Council (BACC) between 2006-2012 and Chairman between 2012-16. He served as chair of the OCCC between 2018-2021.
